During the winter months, the Highway Department will fill the potholes with temporary cold patch, until permanent repairs can be made the following spring.

According to N.Y. HAY. LAW § 58 : NY Code - Section 58: Liability of state for damages –

Between November 15^th and April 30^th the Highway Department is not responsible for damage to vehicles cause by road defect and/or potholes.
