Fence Permit

A Building Permit is required for any fence more than 6 feet (6’) in height. The height of the fence shall be measured from the grade. Also, when a fence of any height is placed on a retaining or freestanding wall and the overall height of both measures more than 6 feet (6’) in height a permit is required.

Deer fence of up to eight (8) feet in height may be constructed, installed, located, or modified without a building permit.

Fences installed within five (5) feet of a retaining wall, that is located within ten (10) feet of the property line, shall be measured from the top of the fence to either the grade at the base of the fence or the base of the retaining wall, whichever height is greater.

Fencing (as well as walls, shrubs, hedges, signage, other structures or growth) for properties located on a corner must not obstruct the vision at the intersection, and may not be more than three (3) feet in height for twenty-five (25) feet from the corner in each direction. Filing Instructions

The following items must be submitted to file for a fence building permit:

  1. Property Owner Affidavit, filled out in its entirety, must be signed by the property owner and notarized.
  2. Recent complete surveys by a licensed land surveyor, showing the entire property and all existing buildings and structures.
  3. Plot Plan indicating scope of work.
  4. Construction Drawings
  5. Certificate of Worker’s Compensation (use form C-105.2 or U-26.3 as applicable).
  6. Copy of Suffolk County Home Improvement License Photo ID card (front and back)
  7. Photos of current conditions and structure
